NERC Hails Edo Judiciary for Adopting NESI Rules

 

Abuja, Nigeria — June 25, 2026 — The Nigerian Electricity Regulatory Commission (NERC) has praised the Edo State Judiciary for adopting the NESI Practice Directions, describing the move as a major step toward strengthening the legal framework of Nigeria’s power sector and fast-tracking electricity-related disputes.

In a statement, the Commission said the Edo State High Court (Nigerian Electricity Supply Industry) Practice Directions, 2026—introduced under the leadership of the Chief Judge, Hon. Justice Daniel Iyobosa Okungbowa—came into effect on May 25, 2026.

NERC noted that the development represents the outcome of its sustained engagement with state judiciaries to remove litigation bottlenecks that have historically hindered the growth of the Nigerian Electricity Supply Industry (NESI).

“The adoption of the NESI Practice Directions is a significant milestone in strengthening the legal and regulatory framework governing the power sector,” the Commission stated.

Highlighting key features, NERC explained that the new rules provide for active case management and expedited hearings for electricity-related matters, alongside mandatory recourse to Alternative Dispute Resolution (ADR) mechanisms before litigation.

The Commission also pointed out that the Practice Directions recognise electronic service of court processes via email and WhatsApp, a move expected to improve efficiency and reduce procedural delays.

In addition, the guidelines introduce streamlined procedures for appeals arising from decisions of the Edo State Electricity Regulatory Commission, including a 30-day filing window and accelerated hearing timelines.

NERC further welcomed the establishment of a dedicated register for electricity market claims, which it said would enhance transparency and improve case tracking within the judiciary.

According to the Commission, the NESI Practice Directions will boost investor confidence, strengthen regulatory enforcement, and ensure timely resolution of disputes in Edo State’s electricity market.

NERC expressed optimism that the initiative would serve as a model for other states seeking to improve legal processes in the power sector and support ongoing electricity market reforms nationwide.
